Title: two men and a bar

Riddle: Two brothers walk into a bar and start to order a drinks. One of the brothers get into a fight with the bartender. The other says dont dont do it but the he dont listen and stabbes the bartender and kills him. They both get arrested and both sent to court but the judge says I know you killed the bartender but I can not send you to prison. why cant he go to prison
